1. Service
The VIN Check provides vehicle history reports sourced from public and licensed databases, enriched with AI-generated insights. Reports are advisory only.
2. Use License and Permitted Purposes
Reports are licensed solely for your personal, non-commercial use in evaluating a vehicle you are considering purchasing, selling, or currently own. Resale, republication, sublicensing, scraping, automated collection, or use of reports as training data for any machine learning or AI model is prohibited without our prior written consent.
Prohibited uses (FCRA and related laws). The VIN Check is not a consumer reporting agency under the federal Fair Credit Reporting Act (FCRA, 15 U.S.C. § 1681 et seq.), and our reports are not “consumer reports” as defined by that law. You agree that you will not use our reports, in whole or in part, for any of the following purposes:
- Determining a consumer’s eligibility for credit, insurance, or insurance underwriting
- Employment screening, hiring, retention, or promotion decisions
- Tenant screening or any housing-related eligibility decision
- Eligibility for a government license or benefit
- Any other purpose covered by the FCRA, the Driver’s Privacy Protection Act (DPPA), or equivalent state consumer-reporting laws
If you intend to make any of the above decisions, you must obtain information from a properly licensed consumer reporting agency that complies with the FCRA. Using our reports for a prohibited purpose is a material breach of these Terms and may result in immediate termination of your access, forfeiture of any account credits, and indemnification obligations under Section 12 below.
3. Disclaimers
Vehicle history data is sourced from public-domain government datasets (including NHTSA recall and complaint records and EPA fuel economy data) and may be incomplete, delayed, or inaccurate. Always perform a physical inspection by a qualified mechanic and verify title status with your local DMV before purchasing a vehicle.
AI-generated content. Portions of our reports include commentary, summaries, or analysis generated by large language models (LLMs). LLM-generated content can be inaccurate, incomplete, or contain fabricated information that appears plausible but is not true (commonly called a “hallucination”). AI commentary is provided for general informational purposes only and is not a substitute for professional inspection, legal advice, mechanical assessment, or independent verification of underlying source data. You agree to independently verify any material fact in an AI-generated section before relying on it.
The service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the maximum extent permitted by applicable law.
4. Limitation of Liability
To the maximum extent permitted by law, our liability is limited to the price paid for the report.
5. Refunds
See our Refund Policy.
6. Privacy
See our Privacy Policy.
7. Referral Program
Customers who purchase a report receive a unique referral link. When a new customer (one with no prior account on The VIN Check, identified by lowercased email) makes their first paid purchase after clicking your referral link, your account is credited with one (1) free Basic-tier report. Credits are tracked against your account credit balance and may be redeemed at checkout against future Basic-tier reports.
What counts as “first purchase.” Attribution is based on the friend’s first ever paid transaction at thevincheck.com — not their first purchase after signing up, not their second after coming back. A friend who already has a transaction history on file at the moment they click your link does not generate a credit.
Attribution window. Your referral link sets a cookie that lasts 30 days from the click. If the friend completes their first purchase inside that window, you earn the credit. If they wait longer than 30 days, or clear cookies, or complete checkout in a different browser, the cookie expires and no credit is generated.
Credits have no cash value and are not transferable, redeemable for cash, or eligible for refund. They expire only if your account is closed or terminated. Self-referrals (using your own link to attempt to credit yourself) are detected and rejected. Coordinated abuse (creating throwaway accounts to farm credits) is also detected and will result in credits being clawed back without notice.
We may modify, suspend, or terminate the Referral Program at any time with reasonable notice. Outstanding credits earned prior to any such change remain redeemable for at least 30 days following notice. The program is void where prohibited by law and is not available to residents of jurisdictions that prohibit referral incentives.
8. Governing Law and Venue
These Terms and any dispute arising out of or relating to them or to your use of The VIN Check are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law principles. You and NH International LLC agree that the exclusive venue for any dispute that is not subject to binding arbitration (if any) will be the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
9. Changes to These Terms
We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date at the top of this page and, where appropriate, by notice via the email address on file. Your continued use of the service after the updated date constitutes acceptance of the revised Terms.
10. Severability
If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, severed from these Terms. The remaining provisions will continue in full force and effect.
11. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Disclaimer, constitute the entire agreement between you and NH International LLC regarding your use of The VIN Check, and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral. Our failure to enforce any right or provision of these Terms will not be a waiver of that right or provision.
12. Indemnification
You agree to indemnify, defend, and hold harmless NH International LLC, its officers, directors, employees, and contractors from and against any claim, demand, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of any report, including any use for a purpose prohibited by Section 2, or (c) your violation of any law or the rights of a third party.
13. Electronic Communications Consent (E-SIGN)
By using the service, you consent to receive communications from us in electronic form (email, on-site notices, or messages displayed through the service) and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that they be in writing. You may withdraw this consent by closing your account, in which case we will be unable to continue providing the service.
